The Center for Constitutional Rights (CCR) [6] has filed the first challenges to key provisions of the Military Commissions Act. CCR filed a habeas petition (Mohammed v. Rumsfeld) on October 2, 2006 on behalf of 25 detainees held at Bagram Air Force Base in Afghanistan who have been detained without charge or trial.
CCR also filed a habeas petition on behalf of Majid Khan [7]on October 3, 2006. Khan is one of the 14 'ghost detainees' tortured in secret and then transferred to Guantánamo.
CCR filed a criminal complaint in Germany on November 14, 2006 charging Rumsfeld, Gonzales, and other administration officials with war crimes for authorizing torture. The MCA, by exempting them in the US, may bolster the case. Letters are needed to the German prosecutor. See the CCR webpage's action center for details.
